These Terms of Service ("Terms") govern your use of SafeBuy (the "Service"). By using the Service you agree to these Terms. If you don't agree, don't use the Service.

1. Who can use the Service

You must be at least 16 years old. If you're using the Service on behalf of an organisation, you confirm you have authority to bind that organisation to these Terms.

2. Accounts

You're responsible for keeping your sign-in credentials secure.
You're responsible for all activity under your account.
Tell us immediately if you suspect unauthorised use of your account.

3. Acceptable use

You agree not to:

Use the Service for any unlawful purpose or in violation of any regulation.
Attempt to bypass rate limits, authentication, or our sign-in paywall.
Scrape, mirror, or resell the reports or underlying data in bulk.
Interfere with the Service's operation (DoS attempts, injection, etc.).
Misrepresent our reports as legal, financial or planning advice.

4. Data sources & accuracy

Reports are generated from publicly available spatial datasets maintained by the Australian Bureau of Statistics, state and territory planning authorities, local councils, Geoscience Australia, and other government agencies. We query these datasets live at the moment you request a report.

While we strive to present this data faithfully, we do not guarantee its accuracy, completeness, currency or fitness for any particular purpose. Government datasets can be out of date, incomplete, or subject to maintenance outages. See the Legal Disclaimer for more.

5. Intellectual property

The Service, its code, branding, and the design and layout of reports are owned by us. The underlying spatial data is owned by the respective government agencies and made available under their open-data licences. You get a personal, non-transferable, revocable licence to view and print reports for your own property due-diligence purposes.

6. Fees

The basic Service is currently provided without charge. We reserve the right to introduce paid plans in future. If we do, we'll give you notice before any charges apply to your account.

7. No professional advice

The Service does not provide legal, town-planning, financial, valuation or construction advice. Reports are informational only. Always consult a qualified professional before making a decision based on a report.

8. Service availability

We aim for high availability but don't guarantee uninterrupted access. Government endpoints go down, Mapbox throttles, things break. We may also suspend or modify the Service for maintenance, upgrades, or to address abuse.

9. Limitation of liability

To the maximum extent permitted by law, we're not liable for any indirect, incidental, consequential, special or exemplary damages arising out of your use of the Service, including (without limitation) loss of profits, loss of data, or loss of opportunity.

Nothing in these Terms excludes or limits any guarantee, right or remedy that cannot lawfully be excluded or limited under the Australian Consumer Law.

10. Termination

You can delete your account at any time via the Support page. We may suspend or terminate accounts that violate these Terms.

11. Changes

We may update these Terms from time to time. Material changes will be noted with a new "Last updated" date. Continued use of the Service means you accept the updated Terms.

12. Governing law

These Terms are governed by the laws of New South Wales, Australia. Any dispute will be resolved in the courts of that jurisdiction.
